K. Hovnanian has petitioned the Queen Anne's County Commissioners to confirm that the termination date of the Developer's Rights and Responsibilities Agreement ("DRRA") between K. Hovnanian and Queen Anne's County governing development of the Four Seasons community on Kent Island has been extended by operation of Maryland law. Since K. Hovnanian and the County entered into the 20 year DRRA on September 17, 2002, Four Seasons has been subject to continuous litigation and administrative challenges that halted development of Four Seasons for at least eight years. Maryland's Courts recognize that development deadlines may be extended when such actions delay the start of a project. For this reason, K. Hovnanian requested the County Commissioners to confirm that the termination date stated in the DRRA is extended by law until September 17, 2030.  K. Hovnanian expressly requested, and the County Commissioners agreed, to hold a public hearing on the Petition so that K. Hovnanian has an opportunity to explain the request. 
Mike Irons, K. Hovnanian's Division President, said, "We have fulfilled every obligation to date under the DRRA and will continue to do so.  K. Hovnanian has constructed a 500,000 gallon water tower, sewer main and pump station and public roads, all of which will be dedicated to the County and will service the Kent Island community in general.  We have also made a $1,000,000 payment to the County and a $238,750 payment to the Kent Island Volunteer Fire Department.  K. Hovnanian is not seeking any changes, revision or relief from any of its obligations under the DRRA.  We are simply asking the Commissioners to confirm that the 8 years we were delayed due to failed attempts to stop the Four Seasons extended the DRRA, so that both parties will have the full 20 years bargained for to fulfill their obligations." 
The public hearing is scheduled for April 9, 2019 at 7 pm in the County Commissioners hearing room 107 N. Liberty Street, Centreville.   BQA Chairman, Steve Donovan, encourages BQA members to join him at the hearing to support K. Hovnanian's Petition to confirm that the DRRA is extended due to failed legal actions that substantially delayed the project from moving forward. Jamal Property - The concept plan to construct six (6) mixed use buildings which will consist of commercial apartments retail and office space was approved by the Planning Commission. 

Mears Project - Mark Meisel of Mears Point Associates, Joe Stevens, Esq. and Daniel Klein of Klein Enterprises gave an update to the Planning Commission. Klein Enterprises of Baltimore replaces Southern Management as the new partner for this project. 

Klein Enterprises is a vertically integrated Real Estate Development Company that has been in business since 1948. They have developed numerous projects throughout the State of Maryland including 11 multi-family communities with over 2,000 unites, The goal is to put a shovel in the ground late in the 3rd or 4th quarter of 2019.

Vertically Integrated: The combination in one company of two or more stages of production normally operated by separate companies.

The Queen Anne's County Commissioners voted to offer Sandra Early an appointment on the Department of Emergency Services Council for a two year term! 

According to Sandra, "I put the notice in the BQA newsletter that there were openings on county boards and decided maybe I should offer to volunteer my time."

With 16 years serving as an administrator/bookkeeper for the Kent Island Volunteer Fire Department she should be a great asset to this council!
